    Why is Marriage Registration Important? Know How to Get a Marriage Certificate and Its Legal Benefits

    Importance of Marriage Registration

    In India, the tradition of getting married through customary rituals is centuries old. However, with changing times and evolving legal requirements, marriage registration has now become a mandatory process. Many people assume that marriage registration is only necessary under the Special Marriage Act, but the truth is that it is equally important for marriages conducted under the Hindu Marriage Act, 1955.

    Marriage Certificate: A Valid Legal Identity

    A Marriage Certificate is not just an official government document—it is legal proof that two individuals are lawfully married. In a landmark judgment in 2006, the Supreme Court of India made marriage registration mandatory for all religions to protect the rights of women. Without this certificate, couples may face various legal and administrative issues.

    As per the Hindu Marriage Act, the minimum age for the groom is 21 years and for the bride is 18 years. Under the Special Marriage Act, both parties must be at least 21 years of age.

    Documents Required for Marriage Registration

    To register a marriage, certain documents are mandatory. These include:

    • Application form
    • Wedding invitation card
    • Age and address proof of both partners
    • Passport-size photographs
    • Affidavits on Rs.10 stamp paper (one each from bride and groom)

    Additional documents may be needed:

    • Divorce decree if previously married
    • Death certificate if a former spouse is deceased
    • Gazette notification for name change
    • Certificate of marital status if one party is a foreign national

    For witnesses, PAN cards and address proofs are required.

    Marriage Registration Process

    The process is simple but needs to be followed step-by-step. The couple must visit the Sub-Divisional Magistrate (SDM) office in the area where the marriage took place or where either of them resides.

    After submitting the application and documents, they are verified, and an appointment date is given.

    • Under the Special Marriage Act, the process may take around 60 days.
    • Under the Hindu Marriage Act, registration is usually completed within 15 days.

    On the appointment day, both spouses and witnesses must be present. Many states now also allow online registration, making the process more convenient.

    Where is the Marriage Certificate Useful?

    A Marriage Certificate is required for several key purposes:

    • Applying for a visa on the spouse’s name
    • Buying property under joint ownership
    • Applying for a home loan
    • Proving marital status internationally, as many foreign embassies do not recognise traditional marriages
    • Inheritance of property
    • Claiming insurance benefits
    • Applying for family pension
    • Passport application, bank accounts, name change, and child custody matters

    It confirms the legal rights and responsibilities between the husband and wife and serves as valid proof in case of marital disputes.
